Smart AI (“Smart AI,” “we,” “us,” or “our”) provides an AI-powered content creation and content assetization platform, including tools for generating and managing images, videos, audio, music, scripts and other digital content, as well as features for presenting eligible content as NFTs or other on-chain digital assets. This Privacy Policy explains how information is collected, used, disclosed, retained and protected when users access or use the Smart AI Creator Center and related services.

1. Scope

This Privacy Policy applies to the Smart AI Creator Center, related websites, applications, APIs and services that link to or reference this Policy. Third-party websites, wallets, blockchain networks, decentralized applications and services are governed by their own privacy practices.

2. Information We Collect

Depending on how the service is used, we may collect the following categories of information:

Account information, such as account identifier, username, email address or other login information where applicable.

Wallet and blockchain information, including public wallet addresses, transaction hashes, token/NFT interactions and other information recorded on supported public blockchains.

Creator content and inputs, including prompts, uploaded images, video, audio, text, reference materials and other content submitted for AI generation or editing.

Generated content and associated metadata, including generation parameters, creation history, publication status and asset-related metadata.

Subscription, credit and payment information, including plan type, credit usage, purchase records and transaction status. Payment card or third-party payment credentials may be processed directly by payment providers rather than stored by Smart AI.

Technical and usage information, such as IP address, device and browser information, operating system, language, timestamps, log data, feature usage, crash information and security events.

Communications and support information that users provide when contacting customer service or participating in platform feedback, campaigns or community activities.

3. How We Use Information

We may use collected information to:

Provide, operate and maintain AI creation, content management, publishing, asset presentation and related platform functions.

Process subscriptions, credits, payments and account transactions.

Generate requested content and maintain creation history and user libraries.

Support NFT or on-chain asset functions initiated by users and display related blockchain information.

Authenticate users, prevent abuse, investigate security incidents and protect the integrity of the service.

Improve product performance, reliability, usability and AI generation workflows.

Provide customer support and communicate service, security, policy and operational updates.

Comply with applicable law, lawful requests, sanctions requirements, dispute resolution and enforcement of our agreements.

4. AI Content Processing

Content submitted to AI generation features may be processed by Smart AI systems and, where necessary, contracted infrastructure or model service providers solely to provide and improve the relevant service in accordance with applicable agreements and settings. Users should not submit confidential information, personal data of others without authorization, or content they do not have the right to use.

Where product settings or a specific service notice provide users with choices regarding model improvement or data use, Smart AI will apply those choices as described in the applicable interface or notice.

5. Blockchain and Public Information

Blockchain transactions are generally public, permanent and outside Smart AI’s unilateral control. Public wallet addresses, token transfers, NFT ownership, smart-contract interactions and transaction records may remain publicly accessible even if a Smart AI account is deleted. Smart AI cannot delete or modify information independently recorded on a decentralized blockchain.

6. Cookies and Similar Technologies

We may use cookies, local storage and similar technologies for authentication, security, preferences, analytics and service functionality. Where required by applicable law, consent or preference controls will be provided for non-essential technologies.

7. How We Share Information

We may disclose information only as reasonably necessary to operate the service, including to:

Cloud hosting, storage, AI infrastructure, analytics, security, customer support and payment service providers acting on our behalf.

Blockchain networks and smart contracts when a user initiates an on-chain action.

Professional advisers, auditors, insurers or prospective transaction counterparties subject to appropriate confidentiality obligations.

Government authorities or other parties where disclosure is required by law or reasonably necessary to protect rights, safety, security or the integrity of the service.

A successor entity in connection with a merger, acquisition, restructuring or transfer of relevant business assets, subject to applicable law.

We do not sell personal information in the ordinary meaning of selling data for monetary consideration. If applicable law defines “sale” or “sharing” more broadly, required notices and choices will be provided.

8. International Data Transfers

Smart AI and its service providers may process information in countries other than the user’s country of residence. Where required, we use appropriate legal mechanisms and safeguards for international transfers of personal data.

9. Data Retention

We retain information for as long as reasonably necessary to provide the service, maintain security and records, resolve disputes, enforce agreements and meet legal obligations. Retention periods vary according to the type of information and purpose of processing. Public blockchain data is not controlled by Smart AI and may remain permanently available.

10. Data Security

We use reasonable administrative, technical and organizational safeguards designed to protect information against unauthorized access, loss, misuse or alteration. No online service, blockchain system or storage method can be guaranteed to be completely secure, and users are responsible for protecting account credentials, wallet keys and devices.

11. User Rights and Choices

Depending on applicable law and the user’s location, users may have rights to request access, correction, deletion, portability or restriction of certain personal information, or to object to certain processing and withdraw consent where consent is the legal basis. These rights may be subject to legal exceptions and cannot require Smart AI to alter immutable public blockchain records.

Requests may be submitted through the privacy or support contact published on the official Smart AI website or application. Smart AI may take reasonable steps to verify the requester’s identity.

12. Children and Age Requirements

The service is not intended for children below the minimum age required to independently consent to online services in their jurisdiction. Users who have not reached the age of legal majority may use the service only where permitted by applicable law and with any required parent or guardian authorization.

13. Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes in the service, technology, law or business practices. Material changes will be communicated through the service or other appropriate channels, and the updated effective date will be stated in the revised Policy.
